Official Rules
NO PURCHASE NECESSARY. Open only to registered members of Heybutler.com ("Members")
who are legal residents of the United States other than Arizona, Florida, Iowa,
Nebraska, New York and Rhode Island, who are 18 years of age or older as of the
date of entry. Void in Arizona, Florida, Iowa, Nebraska, New York, and Rhode Island
and all other countries and jurisdictions and wherever prohibited by law. Employees
of Heybutler.com LLC ("Sponsor") and their respective affiliates,
subsidiaries, advertising and promotion agencies, suppliers and the immediate
family members and/or those living in the same household of each are not
eligible. By participating, entrants agree to be bound by the Official Rules
and the decisions of the Sponsor, and they represent and warrant that they meet
the eligibility requirements set forth herein. All federal, state, local laws
and regulations apply.
TO REGISTER: All entrants must be Members of Heybutler.com. Membership
registration and membership are free. To become a Member, go to
www.Heybutler.com and click on "[Become a Member.]" Provide full
name and e-mail address to create a membership. Alternatively, send an e-mail
to with the subject line "HEYBUTLER.COM Membership" or send a 3x5 postcard
titled "HEYBUTLER.COM Membership" to the address set forth at the end of these
Official Rules and provide your full name, address, phone number (including
area code) and e-mail address (if available). There are no limits on the
number of Members in a household who can enter, provided that each Membership
is limited to one per person.
TO ENTER: Beginning at 12:00 AM Eastern Time each day through
11:59 PM Eastern Time of the same day, log onto to your membership account, follow
the link to the Heybutler.com Lucky Butler Sweepstakes and click on up to five
logos displayed on the webpage to enter for a chance to instantly win one or
more of the prizes described herein. Moreover, upon clicking on one of the five
logos, if Member receives the message, "Entry" entrant will be automatically
registered for a monthly drawing held at 11:59pm on the last day of each month
for [$2,080.00] in either cash (by check) or prepaid gift cards to be used for
gasoline purchases as described in further detail herein. Alternatively, send a
3x5 postcard titled "HEYBUTLER.COM Lucky Butler Sweepstakes" with entrant's
full name, address, phone number (including area code), e-mail address (if
available), and the names of any five of Sponsor's advertisers to the address
set forth at the end of these Official Rules. For daily entries received by
mail, within two (2) business days of receipt, Sponsor shall click the five
advertiser logos selected by entrant and shall notify entrant (as provided
below) if entrant wins a prize. If entrant provides any advertisers, whose
logos are not displayed on the Lucky Butler Sweepstakes webpage at the time
Sponsor clicks to submit entrant's logo choices, Sponsor may substitute another
advertiser's logo, in Sponsor's sole discretion.
All mailed entries must be
received by 11:59 p.m. EST on the 21st day of each month in order to be
eligible for that month's drawing. Website entries must be received by 11:58pm
EST on the last day of each month in order to be eligible for that month's
drawing. A Member may select no more than five logos each day, and selecting
more than five logos in any day may result in disqualification. Mailed entries
are limited to one (1) entry per day per Member. Multiple entries will
disqualify the Member. Sponsor may modify the terms or terminate this
Sweepstakes at anytime, in Sponsor's sole discretion with no prior notice.
Entries submitted via scripts
and automated submission services will be rejected and result in the
disqualification of the Member from the sweepstakes. Heybutler.com LLC is not
responsible for lost, interrupted or unavailable network, server or other
connections, miscommunications, computer or software malfunctions or telephone
transmission problems or technical failures or other errors or malfunctions of
any kind whether human, mechanical, electronic or otherwise.
No mechanically reproduced
entries of any kind permitted. Illegible and incomplete entries are void.
Sponsor is not responsible for lost, late, misdirected entries or entries not
received. In the event of a dispute over who submitted an entry, the entry will
be deemed to have been submitted by the registered Member.
RANDOM
MONTHLY DRAWING: One (1) winner
will be selected by random drawing on a monthly basis on the last day of each
month from all eligible entries received. Entries from previous months will not
be eligible for the drawings held in each subsequent month. Decisions of
Sponsor are final on all matters. There is no limit on the number of times an
entrant may win. ODDS OF WINNING WILL DEPEND UPON THE NUMBER OF ELIGIBLE
ENTRIES RECEIVED. Purchases of Sponsor products or services or products and
services advertised by Sponsor will not increase odds of winning.
DAILY LOGO CLICK ENTRIES: Each participating advertiser provides Sponsor with
a logo for use by Sponsor on Sponsor's website in connection with the daily
logo click contest. ODDS OF WINNING ANY POSSIBLE PRIZE AT ANY GIVEN TIME IN
THE DAILY LOGO CLICK CONTEST WILL DEPEND UPON THE NUMBER OF SPONSOR'S PARTICIPATING
ADVERTISERS, THE NUMBER AND TYPES OF PRIZES THE SPONSOR HAS AVAILABLE TO GIVE
AWAY, AND THE NUMBER OF ELIGIBLE REGISTRATIONS RECEIVED. Purchases of Sponsor
products or services or products and services advertised by Sponsor will not
increase odds of winning.
NOTIFICATION: Winners of the monthly drawings will be notified by
email to the email address provided in their Membership registration within
sixty (60) days following the applicable drawing. Monthly winners will be
notified by telephone at the telephone number provided in winner's membership
registration in the event of a postcard entry. Winners of the daily logo click
entries will be notified by email to the email address provided in their
Membership registration within sixty (60) days of entry. Daily winners will be
notified by telephone at the telephone number provided in winner's membership
registration in the event of a postcard entry. Sponsor shall have no liability
for a winner's failure to receive notices due to winners' spam, junk e-mail or
other security settings or for winners' provision of incorrect telephone
numbers. If a winner cannot be reached after reasonable efforts have been
exerted during the sixty (60) days from the date of the applicable Sweepstakes
drawing, or if he/she is found to be ineligible, or if he/she cannot or does
not comply with these Official Rules, such winner will be disqualified and an
alternate winner may be selected. A list of winners (including full first name
and initial of last name) will also be available on the website.
PRIZES:
For each logo that a Member clicks on the website, the Member has an instant
chance to receive a coupon or gift certificate ranging in value from $2.00 to [$100.00],
a monetary award ranging from $2.00 to [$100.00], a chance to participate in
the monthly drawing, and tickets to local events ranging in value from $5.00 to $200.00.
HOWEVER, NO ENTRANT IS GUARANTEED TO WIN ANY PRIZE OF ANY KIND. The prize for
each monthly drawing will be $2,080 payable in the form of a prepaid gift card
or monetary award (to be determined by the Sponsor, in Sponsor's sole
discretion) that the winner may use for gasoline purchases. THE PRIZE FOR THE
MONTHLY DRAWING SHALL NOT EXCEED [$2,080].
Total prizes awarded during
the Sweepstakes period will not exceed [$30,000] annually. No
substitution of prizes or transfer/ assignment of prizes to others or request
for the cash equivalent by winners permitted, except as otherwise expressly
provided herein. Daily and monthly winners must claim prizes
by return e-mail, telephone call, or facsimile transmission to Sponsor and
providing such winner's address in an eligible U.S. State within thirty (30)
days of Sponsor's notification. Sponsor will have no liability for prizes
unclaimed after this time. The prize will be sent to winners within thirty (30)
days after such winner makes its claim. Winners shall be responsible for any shipping
and handling fees, as well as any surcharges, ticketing or similar
administrative fees.
TAXES: All federal, state and local taxes are the sole
responsibility of winners. All federal, state and local laws and regulations
apply.
AFFIDAVIT; CONSENT TO USE: Winners or potential winners may also be required to
sign and return an Affidavit of Eligibility/Release of Liability/Prize
Acceptance Form postmarked within 10 days of Sponsor's request. Noncompliance
within this time period may result in disqualification and an alternate
potential winner may be selected. Return of any prize/prize notification as
undeliverable will result in disqualification. All winners must produce picture
or some other form of proper identification to claim any prize. Sponsor
reserves the right to substitute any prize with prize of equal or greater
value. Acceptance of any prize constitutes permission
to the Sponsor to use winners' first name and surname initial on its website,
and may use winners first name and surname initial, voice, statements, image
and likeness for purposes of advertising, in any medium, without further
compensation, unless prohibited by law.Moreover,
by entering this Sweepstakes, entrants consent to and authorize the inclusion
of their name on Sponsor's email mailing lists. Sponsor will not sell or
otherwise provide any information provided by any entrant to any third party,
including without limitation any affiliate of Sponsor. Entrants may request to
be removed from Sponsor's mailing lists by going to the website and following
the instructions to unsubscribe or by sending an e-mail request to.
TERMS:
Sponsor, its suppliers, agents, affiliates,
consultants and service providers are not responsible for any typographical or
other error in the printing, the offering or the announcement of any prize or
in the administration of the promotion, whether caused by computer, technical
or human error. Winners assume all liability and agree to hold Sponsor, its
suppliers, advertisers, agents, affiliates, consultants and service providers
harmless for any injury or damage caused, or claimed to be caused, by
participation in this promotion or use or redemption of any prize. Sponsor, its suppliers, agents, affiliates,
consultants and service providers are not
responsible for late, lost, damaged, incomplete, illegible, faulty, or
incorrect transmissions, incorrect announcements of any kind, technical
hardware or software failures of any kind, any damage to any person's computer
related to or resulting from participating in the online portion of the
promotion, lost or unavailable network connections, or failed, incomplete,
garbled or delayed computer transmission that may limit a user's ability to
participate in the sweepstakes whether caused by computer, technical or human
error. Sponsor reserves the right to cancel or modify the program at any time
and for any reason, including but not limited to, destruction of the integrity
of the promotion by fraud, misconduct or technical failures, or if a computer
virus, bug, or other technical problem corrupts the administration, security,
or proper administration of the promotion as determined by Sponsor, in its sole
discretion. Sponsor reserves the
right to disqualify, freeze or prohibit the
participation of an individual if fraud or tampering is suspected, or if the
individual fails to comply with any requirement of participation or with any provision
in these Official Rules. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE OR
UNDERMINE THE OPERATION OF THIS PROMOTION IS A VIOLATION OF CRIMINAL &
CIVIL LAWS. SPONSOR RESERVES THE RIGHT TO DISQUALIFY AND/OR SEEK DAMAGES FROM

consultants and service providers, from any liability, loss, harm, damage, cost
or expenses whatsoever incurred which may occur in connection with any part of
this Sweepstakes and with the acceptance, ownership, and/or use of the
prizes. ALL PRIZES, AND ANY SUBSTITUTIONS THEREFOR WILL BE AWARDED "AS
IS," AND SPONSOR EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR
IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY
